A two-year maintenance bond is required to be submitted to the city, in the amount of 50 percent of the cost of the improvements to be accepted; which bond shall be as approved by the city attorney, and submitted prior to acceptance of all improvements. If the improvements are less than the amount of the street and utility construction bond or performance bond that was provided by the contractor for the work, and that street and utility construction bond or performance bond provides for two-year maintenance of the improvements to be accepted, an additional two-year maintenance bond will not be required prior to acceptance of the project.
