(1) The amusement devices and games of skill herein referred to are those types which are required by the state of Washington to pay to the said state 20 percent or more of the income of such devices and games to the said state of Washington, it being understood and construed that a bona fide merchandising device or machine used solely for the dispensing of merchandise shall not be included and shall be excepted from the operation of this chapter.

(2) Any amusement devices or games of skill by the operation of which the operator of such devices or games shall receive monies or merchandise or other items of value through skills shall be included within this chapter. (Ord. 25 § 2, 1955)
