(1) The following shall constitute exceptions to the requirement of ECMC 13.15.020:

(a) Any property which receives city water but upon which there are no buildings.

(b) Any property which receives city water and upon which there are buildings that are not used for domestic purposes and to which the water system is not connected.

(c) Any property which receives city water and upon which there are buildings to which the city water is connected but which do not require connection to the city sewerage system; provided, however, said lots shall only be exempt from the requirements of ECMC 13.15.020 after application has been made to the approving authority and a sufficient showing made to the approving authority as to why the property should not be required to be connected to the city sewerage system.

(d) Construction of a building to be served by sanitary sewer service where the facility or building is located more than 200 feet from a public sewer, or where special circumstances, certified by the approving authority, would impose a similar hardship.

(2) In determining whether or not to grant such an exemption, the approving authority shall consider the effect such exemption would have upon city revenue, health, sanitation, and/or for comprehensive planning.

(3) If an exempted private wastewater disposal system fails, either the tank or drain field, and where the facility or building is greater than 200 feet of the city’s system at the time of failure, the owner shall request a new exemption for the city, per this chapter.

(4) All private wastewater disposal systems shall be constructed, maintained, and abandoned in accordance with Chapter 246-272A WAC as now enacted or hereafter amended.

(5) All existing properties with private wastewater disposal systems within 200 feet of the city sewer, as measured from the sewer main to the nearest point of the residence or facility, shall be required to connect within 90 days of the transfer of ownership or sale of the property.

(a) An additional 90 days to connect may be granted, upon written request to the public works director, where inclement weather prevents connection within the required time period, or if the cost of the connection would exceed $7,000.

(b) If the city installs a sewer main all properties falling within the 200-foot limit of that new line, as measured from the sewer line to the nearest point of the residence or facility, shall connect within one year of the commencement of that installation. (Ord. 524 § 1, 2017)
